The Freedom of Information Act is a law that allows any person access to federal agency records. All federal agencies, including the Pension Benefit Guaranty Corporation (PBGC), have the duty to release records to the public. To balance the public's right to know with efficient government operations, the FOIA allows all agencies to withhold nine categories of information from the public if disclosure of that information would harm government or private interests.

The Privacy Act allows individuals to gain access to their own personal records subject to certain exemptions, and to seek correction or amendment of records maintained by PBGC. An individual may also request PBGC to release their records to a third party. If you are seeking records on yourself, you will be required to verify your identity.

Obtain a Form 1099-R or Income Verification Letter

MyPBA is only for individuals who are entitled to receive a PBGC benefit. You may be able to obtain your Form 1099-R or verification of income letter without submitting a Privacy Act request by visiting My Pension Benefit Access.
